__________ | Version: __________ | Last Reviewed: __________
This Redundancy Policy sets out __________'s (the "Company") approach to managing redundancy situations fairly, consistently and in compliance with UK employment law, including the Employment Rights Act 1996, the Trade Union and Labour Relations (Consolidation) Act 1992 ("TULRCA") and the Equality Act 2010.
This Policy does not form part of any employee's contract of employment and may be updated from time to time to reflect changes in legislation or best practice.
1. SCOPE AND PURPOSE
(1.1) This Policy applies to all employees of the Company and sets out the procedure the Company will follow whenever a redundancy situation arises.
(1.2) The Company is committed to: (a) avoiding compulsory redundancies wherever possible; (b) following a fair and transparent selection process; (c) consulting fully and meaningfully with affected employees; and (d) supporting employees through the process with reasonable notice, appropriate payments and assistance with redeployment and job-seeking.
2. DEFINITION OF REDUNDANCY
(2.1) A dismissal is by reason of redundancy where it is wholly or mainly attributable to: (a) the fact that the employer has ceased or intends to cease to carry on the business for the purposes of which the employee was employed; (b) the fact that the employer has ceased or intends to cease to carry on that business in the place where the employee was employed; or (c) the fact that the requirements of the business for employees to carry out work of a particular kind, or for employees to carry out work of a particular kind in the place where the employee was employed, have ceased or diminished or are expected to cease or diminish.
(2.2) Redundancy is not the same as dismissal for performance, conduct, or capability. This Policy applies only to genuine redundancy situations.
